Ok here is a little problem.  My sons mother decided to be a hero and get him a new phone.  So she bought one off craigslist from some lady.  Well the seller didn't remove any data or the number assigned to it (which is still in her name) He took it to sprint and they said they can't reprogram it to his phone number. (legal issues I believe) and told him to just jailbreak it.

I am comfortable rooting the thing but wonder how to assign it to a different number and account.

Any suggestions?

I'm not sure "Jail-breaking" (rooting) will do anything toward accessing his account or phone number. I would think that those features would be totally under the control of the service provider, in this case Sprint. You might ask them to elaborate on what they mean by "Legal Issues" so that you can make some clearer decision on what you can and can't do with the phone.

Technically jailbreak wont do anything for your account. The main phone info will still show up as the number and info of the original owner.

The original owner has to have sprint cancel her number on that phone or if sprint has some type of over the air program feature like the *228  option like verizon, she can switch her info to a new phone which will deactivate the phone you bought. Then you can *228 the phone and put your sons number on it and it will also update his account with that phone..
